This Privacy Policy describes how we collect, use, disclose and protect the personal information we obtain through our SaaS (Software as a Service) platform for plastic injection manufacturing, our website and related services. This policy has been designed to comply with applicable data protection legislation, including, but not limited to, the Mexican Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP) and its Regulations, as well as to align with international standards such as the European Union's General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA), for the benefit of all our clients and users, regardless of their country of residence.

Please read this policy carefully to understand our practices. By using our platform and services, you agree to the practices described in this document. If you do not agree with this policy, please do not use our platform.

2. Information We Collect

We collect different types of personal information in order to offer and improve our manufacturing services.

2.1. Information you provide directly to us:

  • Identification and Contact Data:

    Full name, email address, phone number, job title, company you work for.

  • Billing and Payment Data:

    Depending on the payment method chosen, we collect the information necessary to process your payment and issue the corresponding receipts.

      If you pay via gateway (credit/debit card): The transaction is processed directly by our international payment service providers (gateways). We do not store or have access to your complete card details (such as CVV or full number) on our servers. These providers handle such information securely under their own privacy policies.

      If you pay via bank transfer (mainly for companies in Mexico): We collect and store the information necessary to validate and reconcile the payment, as well as to issue your tax invoice (CFDI). This may include: your Tax Regime, RFC (Federal Taxpayer Registry), business name, and in some cases, the transfer receipts you provide us, which may contain data such as your name, the issuing bank and the last digits of your account. Tax Data: In both cases, to comply with tax obligations in Mexico (issuance of CFDI), we collect your RFC, business name and zip code.

  • Technical and Production Data:

    For the operation of our SaaS platform, we may process data related to your plastic injection parameters, production orders, machine efficiency, and other technical information necessary for the provision of the service. This information is usually associated with your company and not with you as an individual, but when it can identify you directly or indirectly, it will be treated as personal data under this policy.

2.2. Information we collect automatically:

When you visit our website or use our SaaS platform, we may automatically collect certain technical information through cookies and other tracking technologies:

  • Usage and Browsing Data:

    IP address, browser type, Internet service provider, referring/exit pages, operating system, date/time stamps and clickstream data to analyze trends, administer the site, track user movement and gather demographic information.

    We may process your data to comply with obligations established by law, such as maintaining financial records, fraud prevention or responding to authorities' requirements.

  • For the Satisfaction of Legitimate Interests:

    We use your data to improve and personalize your experience, analyze the use of our platform to develop new functionalities, ensure the security of our systems and send you communications about changes in our services or technical information relevant to your business.

  • Based on your Consent:

    When you have given your explicit consent, we may use your data to send you newsletters, marketing materials, event invitations or conduct satisfaction surveys. You may withdraw your consent at any time.

For transfers from the European Economic Area (EEA) or the United Kingdom, we rely on approved transfer mechanisms, such as the Standard Contractual Clauses (SCC) adopted by the European Commission, to guarantee an adequate level of protection for your data.

The security of your information is a priority for LOGYKOPT. We have implemented and maintain robust administrative, technical and physical security measures to protect your personal data against damage, loss, alteration, destruction or unauthorized use, access or processing. These measures include:

  • Access Control:

Generally, your data will be retained for the duration of your contractual relationship with us. Once such relationship ends, personal data may be blocked and subsequently deleted, in accordance with internal document retention policies and applicable statutory limitation periods in Mexico.

9.1. ARCO Rights (for residents in Mexico):

In accordance with the LFPDPPP, you have the right to:

    Request correction of your information if it is outdated, inaccurate or incomplete.

  • Cancellation:

    Request that we delete your data from our records (when there is no legal obligation preventing it).

  • Opposition:

    Object to the processing of your data for specific purposes.

9.2. Additional Rights (for residents in the European Union, California, etc.):

If you are in the European Economic Area (GDPR) or are a California resident (CCPA/CPRA), in addition to rights similar to ARCO, you may have the right to:

  • Restriction of Processing:

    Request that we restrict the processing of your data under certain circumstances.

  • Data Portability:

    Request to receive your personal data in a structured, commonly used and machine-readable format, and transmit it to another controller.

  • Opt-out of Sale or Use for Targeted Advertising:

    Object to a decision based solely on automated processing, including profiling, that produces legal or significant effects concerning you.

9.3. How to Exercise Your Rights:

    2. Documents proving your identity (or that of your representative).

We will respond within a maximum period of 20 business days (for Mexico) and within the month established by the GDPR, informing you about the outcome of your request. If appropriate, it will be made effective within 15 business days following the response communication.

We reserve the right to update or modify this Privacy Policy at any time to reflect changes in our practices, technologies, legal requirements or other factors. Any material changes will be notified through our platform or by email (whenever possible), and the 'Last updated' date at the top of the policy will be modified.
